Terms & Conditions

The use of the platform available under the Internet domain www.here-away.com (the “Platform”) and any services offered through the Platform by Here & Away (“Here & Away”) is subject to the following Terms & Conditions (“T&C”). By accessing, browsing, or using the Platform, you agree to comply with and be bound by these T&C. If you do not agree, you should not use the Platform. Here & Away may update or modify these T&C at any time, and such changes will be effective immediately upon posting.

Here & Away operates a curated travel platform that highlights unique hotels, guesthouses, and vacation rentals selected for their authenticity, design, and cultural depth.

The Platform provides:

• Editorial features and property showcases
• Booking pathways that connect travelers with properties or booking partners
• An online store with curated travel-related items and merchandise

Booking Pathways

Bookings and enquiries facilitated through the Platform may follow different pathways:

• Enquiry Facilitation: Users may submit enquiries to properties through the Platform. These enquiries may be sent directly to the property and/or to Here & Away. Here & Away may assist in facilitating communication but is not a party to any agreement unless explicitly acting as a travel advisor.
• Direct Booking Assistance: Travelers may request booking support through Here & Away. In such cases, Here & Away may coordinate with the property or booking partners to confirm availability, pricing, and applicable benefits. The booking contract remains directly between the traveler and the property or booking partner.
• Third-Party Booking Links: Some listings include links to third-party booking platforms (such as Booking.com). These may generate affiliate commissions for Here & Away. All transactions are governed by the third-party provider’s terms.
• Travel Advisor Services: In certain cases, Here & Away acts as a travel advisor through affiliated partners such as Fora Travel. Here & Away may facilitate bookings on behalf of the traveler and earn commissions from participating partners. Any applicable benefits are provided subject to partner terms.

Property Display

Properties may be presented using different display and booking configurations, including direct links, enquiry forms, or third-party booking links, depending on the arrangement with Here & Away.

These configurations do not affect the contractual relationship between the traveler and the property or booking provider.

Important Notice

Here & Away does not own or operate the accommodations listed on the Platform.

All bookings, payments, and agreements are made directly between the traveler and the respective property or third-party provider.

Here & Away operates an online store that includes:

• Here & Away Merchandise: Designed by Here & Away and produced through print-on-demand partners. Orders are fulfilled and shipped directly by fulfillment partners, with payments securely processed by third-party providers.
• Affiliate Partner Items: Certain items may be offered through affiliate programs. When users click “Buy Now,” they are redirected to the third-party retailer’s website to complete the purchase. All transactions are governed by the retailer’s terms, and Here & Away may earn a commission from these sales.
• Partner-Offered Items: Some items are offered directly by Here & Away’s accommodation partners. In these cases, the “Buy Now” button redirects to the partner’s own online store or website. Transactions, fulfillment, and customer service are managed entirely by the partner, and Here & Away is not a contractual party to the sale.

Property information presented on the Platform is provided by property owners or affiliates. Owners are responsible for the accuracy of availability, rates, amenities, and images. While Here & Away strives for accuracy, it does not guarantee it and is not liable for discrepancies. Travelers are encouraged to confirm details directly with properties.

All text, design, images, graphics, videos, and other content on the Platform are the intellectual property of Here & Away or its licensors, unless otherwise noted. Content may not be used without prior written permission.

Media supplied by properties remains their property. Here & Away uses it under non-exclusive license for editorial and promotional purposes, with credit provided whenever possible.

Users agree to:

• Use the Platform for personal, non-commercial purposes.

• Comply with applicable laws.

• Not engage in fraudulent, abusive, or unlawful behavior.

• Not impersonate others or misuse the Platform for unauthorized purposes.

The Platform may include links to third-party websites. Here & Away is not responsible for their content, policies, or practices. Some third-party links may include tracking mechanisms (such as affiliate tracking) that allow Here & Away to receive commissions.

If users submit reviews, photos, or other contributions, they grant Here & Away a royalty-free license to use them for editorial and promotional purposes.

Here & Away may publish guest reviews submitted by travelers who booked through the Platform. Reviews may appear on partner property pages to help future travelers make informed decisions. Here & Away reserves the right to edit or remove any content at its discretion.

Here & Away acts as a facilitator of editorial content and booking referrals. It is not a contracting party to guest bookings. Here & Away is not liable for:

• Booking cancellations, delays, or changes.

• The outcome of communications between users and properties, including response times, availability, or booking confirmations.

• Accuracy of property listings or rates.

• Quality of accommodations, services, or amenities.

• Disputes between travelers and properties.

• Issues with store orders fulfilled by third parties or partner-offered stores.

Here & Away may update these T&C at any time. Continued use of the Platform constitutes acceptance of updated terms.

These T&C are governed by the laws of Florida, USA. Disputes will be resolved through binding arbitration in Miami-Dade County, Florida.
