1. Introduction

The use of the platform available under the Internet domain www.here-away.com (the “Platform”) and any services offered through the Platform by Here & Away (“Here & Away”) is subject to the following Terms & Conditions (“T&C”). By accessing, browsing, or using the Platform, you agree to comply with and be bound by these T&C. If you do not agree, you should not use the Platform. Here & Away may update or modify these T&C at any time, and such changes will be effective immediately upon posting.

2. Purpose and Services

Here & Away operates a curated travel platform that highlights unique hotels, guesthouses, and vacation rentals selected for their authenticity, design, and cultural depth. The Platform provides:

  • Editorial features and property showcases.

  • Booking pathways that connect travelers with properties or booking partners.

  • An online store with curated travel-related items and merchandise.

Bookings and purchases facilitated through the Platform follow three main pathways:

  1. Direct Booking with Perks: Travelers may contact properties through Here & Away to book directly. To unlock perks and verify commissions, travelers forward their booking confirmation to Here & Away. The booking contract is always between the traveler and the property.

  2. OTA / Affiliate Links: Some listings include links to third-party booking platforms (such as Booking.com). These links may generate affiliate commissions for Here & Away. All transactions are governed by the third-party provider’s terms.

  3. Travel Advisor Services: In some cases, Here & Away acts as a certified travel advisor through Fora Travel. Here & Away facilitates the booking on behalf of the traveler and earns commissions from participating partners. Any perks available through Fora are passed to the traveler when applicable.

Here & Away does not own or operate the accommodations listed on the Platform. All bookings, payments, and agreements are between travelers and the respective property or third-party platform.

3. Online Store

Here & Away operates an online store that includes:

  1. Here & Away Merchandise: Designed by Here & Away and produced through print-on-demand partners. Orders are fulfilled and shipped directly by fulfillment partners, with payments securely processed by third-party providers.

  2. Affiliate Partner Items: Certain items may be offered through affiliate programs. When users click “Buy Now,” they are redirected to the third-party retailer’s website to complete the purchase. All transactions are governed by the retailer’s terms, and Here & Away may earn a commission from these sales.

  3. Partner-Offered Items: Some items are offered directly by Here & Away’s accommodation partners. In these cases, the “Buy Now” button redirects to the partner’s own online store or website. Transactions, fulfillment, and customer service are managed entirely by the partner, and Here & Away is not a contractual party to the sale.

4. Property Listings and Accuracy

Property information presented on the Platform is provided by property owners or affiliates. Owners are responsible for the accuracy of availability, rates, amenities, and images. While Here & Away strives for accuracy, it does not guarantee it and is not liable for discrepancies. Travelers are encouraged to confirm details directly with properties.

5. Intellectual Property

All text, design, images, graphics, videos, and other content on the Platform are the intellectual property of Here & Away or its licensors, unless otherwise noted. Content may not be used without prior written permission.

Media supplied by properties remains their property. Here & Away uses it under non-exclusive license for editorial and promotional purposes, with credit provided whenever possible.

6. User Responsibilities

Users agree to:

  • Use the Platform for personal, non-commercial purposes.

  • Comply with applicable laws.

  • Not engage in fraudulent, abusive, or unlawful behavior.

  • Not impersonate others or misuse the Platform for unauthorized purposes.

7. Third-Party Links

The Platform may include links to third-party websites. Here & Away is not responsible for their content, policies, or practices.

8. User-Generated Content and Reviews

If users submit reviews, photos, or other contributions, they grant Here & Away a royalty-free license to use them for editorial and promotional purposes.

Here & Away may publish guest reviews submitted by travelers who booked through the Platform. Reviews may appear on partner property pages to help future travelers make informed decisions. Here & Away reserves the right to edit or remove any content at its discretion.

9. Liability Disclaimer

Here & Away acts as a facilitator of editorial content and booking referrals. It is not a contracting party to guest bookings. Here & Away is not liable for:

  • Booking cancellations, delays, or changes.

  • Accuracy of property listings or rates.

  • Quality of accommodations, services, or amenities.

  • Disputes between travelers and properties.

  • Issues with store orders fulfilled by third parties or partner-offered stores.

10. Changes to Terms

Here & Away may update these T&C at any time. Continued use of the Platform constitutes acceptance of updated terms.

11. Governing Law

These T&C are governed by the laws of Florida, USA. Disputes will be resolved through binding arbitration in Miami-Dade County, Florida.
